How Retirees Under 65 with Disabilities Should Prepare for Medicaid Changes

Early retirees with disabilities can secure the right Medicaid category and proof before six-month renewals and work rules start.

Retirees under 65 with disabilities should request a disability-pathway Medicaid determination and organize medical and income proof before 2027 renewals. That action can move coverage out of the income-only expansion group facing work and six-month renewal rules. Medicaid expansion means health coverage based mainly on low income, not age or disability status. The non-MAGI aged, blind and disabled pathway means coverage based on disability status under separate income and asset rules.

Which work rule applies to you?

The 2025 reconciliation law, Public Law 119-21 signed July 4, 2025, requires many Medicaid expansion adults ages 19-64 to complete 80 hours per month of work, school, job training or community service. The Caregiver Action Network summary says states must enforce the rule no later than January 1, 2027, in the 2025 law summary. Adults who qualify through a disability pathway are not subject to that work rule or to twice-yearly expansion redeterminations.

The National Council on Severe Autism draws that line between disability-pathway enrollees and income-only expansion enrollees in its Medicaid coverage update. Check which category is on your current approval letter. If it lists expansion or adult group only, ask your state agency for a disability determination or redetermination.

What counts as medically frail now?

Exempt groups described in The Arc of Massachusetts summary of CMS guidance include medically frail people with substance-use disorder, disabling mental disorders or serious medical conditions. The same summary also lists caregivers of a disabled person, pregnant and postpartum people, veterans with total disability, and SSI recipients in many state descriptions. A diagnosis alone is no longer enough.

KFF analysis of the CMS June 1, 2026 interim final rule, CMS-2454-IFC effective July 31, 2026, says states must apply a functional test in the medical frailty analysis. That test asks whether the condition impairs ability to perform work activities. KFF reporting on Nebraska, which started enforcement May 1, 2026, found 39% of new applicants and 57% of renewals qualified for an exclusion such as parenting a child under 14 or medical frailty.

How does part-time work affect a disability claim?

Social Security defines disability as inability to engage in substantial gainful activity. The Social Security Administration sets that level at $1,620 per month non-blind and $2,700 blind in 2025, rising to $1,690 and $2,830 in 2026. Earnings above that level can defeat a disability-pathway claim, even when health limits are real.

Early retirees who consult, work seasonal shifts, or drive for extra income face the most risk. Ask before 2027 whether your state offers a Medicaid buy-in-for-workers program or another workers-with-disabilities category. Bring pay stubs and hour records so staff can assess gross monthly earnings against the correct limit.

How do you keep coverage through more frequent renewals?

Beginning with renewals scheduled on or after January 1, 2027, states must redetermine most expansion adults every six months instead of annually. The National Association of Counties summary of March 6, 2026 CMS guidance links that change to higher paperwork volume and procedural loss risk in its renewal guidance report.

The National Council on Severe Autism family checklist recommends a paper file now, before the faster cycle starts. Keep your address current with Medicaid, save pay stubs and bank and asset records, keep medical and exemption letters together, and report changes promptly.

  • Confirm mailing address, phone, and online account access
  • File pay stubs, bank statements, pension letters, and asset records by month
  • Keep doctor letters that describe functional limits, not only diagnoses
  • Keep caregiver, pregnancy, veteran, or SSI papers where you can find them
  • Ask for a disability determination or buy-in assessment before your 2027 renewal
