Does a Pension Disability Rating Count Toward a Medically Frail Exemption

Learn how VA pension status relates to Medicaid frailty rules and what medical proof protects coverage.

No. A VA pension disability finding does not by itself make you medically frail under the new Medicaid work rules.

Medically frail is a separate Medicaid decision based on health conditions and work impact, not on pension status. Medically frail means a Medicaid category that can excuse certain expansion adults from work and reporting rules. Veterans Pension means VA's needs-based benefit for wartime veterans with limited income who meet an age or disability gate.

Why pension status is not the test

The blind-or-disabled part of frailty uses Social Security Act section 1614, not VA's rating schedule. The Massachusetts declaration exhibit quoting the H.R.1 statutory text makes that distinction clear in the court exhibit with the statutory language.

That means a pension award and a VA percentage do not decide frailty. VA says pension can rest on age 65 alone, permanent and total disability, SSDI receipt, or nursing-home need. A 65-year-old with limited income can receive pension without a severe work-blocking illness.

What medically frail does require

Frailty covers five groups: blind or disabled status, substance-use disorder, disabling mental disorder, physical or developmental disability that limits daily activities, and serious or complex medical conditions. A diagnosis alone is not enough.

CMS requires both a qualifying condition and proof it significantly impairs the ability to complete 80 monthly hours or meet the earnings threshold. The Georgetown Center for Children and Families explains that two-part test in its explainer on the June 2026 interim final rule.

Where a 100% VA rating fits

A separate veteran exclusion covers veterans with a disability rated as total under 38 U.S.C. 1155.

The American Medical Association summary describes that group as including temporary or permanent 100% schedular ratings and TDIU paid at 100% in its summary of Medicaid community-engagement rules. A veteran rated below 100% does not receive automatic exemption by veteran status. That veteran must qualify through frailty, disability, caregiving, or a compliance activity.

What pension recipients should do

Do not rely on the pension award letter as medical proof. Pursue the frailty path with records showing how a service-connected or other condition limits work compliance.

Bring evidence tied to the two-part test: Ask your clinic for a letter that names the diagnosis and describes the work impact in plain terms. File it with Medicaid before a reporting deadline passes.

  • current diagnosis in one of the five frailty groups
  • exam notes showing limits on standing, walking, focus, attendance, or daily activities
  • statement that the limit significantly impairs completion of required monthly hours
  • hospital, treatment, or home-care records for serious or complex conditions
